Terms of Service & Client Agreement

📋 Agreement Overview: These Terms of Service govern all performance marketing retainer agreements, paid ad management, AI workflow setups, web development builds, and online mentorship packages provided by Mr. Sajjad Alam (Professor Business Expert).

1. Acceptance of Terms

By hiring Mr. Sajjad Alam, enrolling in online courses/mentorship, or utilizing this website, you explicitly agree to comply with and be bound by these Terms of Service. If you disagree with any portion of these terms, you must refrain from utilizing our services.

2. Professional Marketing & AI Services

Services provided include Google Ads PPC, Meta CAPI funnels, N8n AI Agent Automations, Calling AI Voice Bots, SEO, and Core PHP / Next.js Web Engineering:

• Scope of Work: Deliverables, timelines, and target metrics are documented prior to project commencement in writing.
• Third-Party Ad Spend: Paid advertising budgets (payable to Google Ads, Meta Ads, etc.) are funded directly by the client and are completely separate from agency management retainer fees.
• SaaS Subscriptions: External software platform credits (Twilio, OpenAI API usage, WhatsApp API, hosting) are paid directly by the client.

3. Mentorship & Course Terms

The following rules govern all student and working professional learning packages:

• Mentorship Scheduling: Live 1-on-1 sessions must be booked at least 24 hours in advance. Rescheduling requires 12 hours notice.
• Strict Anti-Piracy: All course lessons, N8n workflow blueprints, code templates, and ad strategy frameworks are protected by copyright law. Screen-recording, sharing, or reselling content will result in immediate session termination without refund and legal action.
• No Guaranteed Placement Disclaimer: Mentorship teaches battle-tested practical skills. Career growth, job placement, and client revenue depend on individual effort and market variables. No fixed earnings are guaranteed.

4. Payment Terms, Invoicing & Non-Refundability

• Advance Payments: Agency retainer fees and project milestone payments are due in advance prior to deliverable execution.
• Non-Refundable Work: Once campaign setup, landing page development, N8n workflow building, or mentorship hours have commenced, fees for executed labor are non-refundable.

5. Limitation of Liability & Disclaimers

While we utilize industry-leading CRO strategies to maximize client ROAS and lead quality:

• We are not liable for third-party platform actions, including Google Ads or Meta account suspensions, policy enforcement updates, or ad network outages.
• We are not responsible for client sales closures, call center agent follow-up delays, or unworked leads after successful lead delivery to the client CRM or Google Sheet.

6. Governing Law & Jurisdiction

These terms shall be governed by and construed in accordance with the laws of India. Any legal disputes arising out of these terms shall be subject to the exclusive jurisdiction of the competent courts in Thane / Mumbai, Maharashtra, India.
